However as to the party who posted yes in deed so long as you meet the statutory requirements for defamation.
Different stated focus more or less on the harm to reputation. -

YA naem that person John or Jane Doe ( or call him unidentified)
The website and ISP you serve with subpoenas to get his IP and identity.
Then you amend your complaint ( since there has been no responsive pleading yet) and you name the offender properly. -

Thu, April 3, 2008 - 7:09 PMIt's MYSPACE and it's "safety" software that posts the offending material when you send someone a link to her web site . . . it won't let Alec send, using the MYSPACE email facility, a link to her own site: the MYSPACE software intercepts the link when you click on it from a MYSPACE email and won't let you visit her site. It puts up defamatory material calling it a phishing site and comparing it to headlice . . . I have to sue MYSPACE . . . -

What's the worst that can happen~? They will get dismissed? On the up side the best that can happen is you'll make new law and hold their feet to the fire.
