Named persnos in the US Immigration and Customs Enforcement (ICE) are being sued in New Jersey federal court for violations 4th & 5th amendment, privacy, and due process, of persons suspected of being criminal aliens. (Seton Hall Law report: tinyurl.com/48d2x5 )
The ICE raided the domiciles of various criminal aliens. The plaintiffs assert that no warrants had been issued (complaint here: tinyurl.com/3to9xv ). In the USA an arrest warrant does not authorize the unwanted entry of the state into a private domicile. A warrant for search and seizure must also be issued. The mere fact of the persons being criminal aliens does not lift The warrant burden from the state. If they in the USA they are entitled to the full panoply of due process rights pursuant to the 14th Amendment.
In 2007 in the PR ICE officials were sued for the same thing (here: tinyurl.com/3kb8e8 )( and here: tinyurl.com/3uwp42 ).
In the PR the ICE was invoking the program they call “Operation Return to Sender” (here: tinyurl.com/2a6oty ). Some have alleged that the ICE often ends up invading homes where no criminal aliens are domiciled.
