Tobacco wins one - finally

The Second Circuit US Court of Appeals just recently overturned the class action certification for a lawsuit brought by "light" cigarette smokers ( Here: tinyurl.com/4gj9uz ) against Philip Morris USA Inc., R.J. Reynolds Tobacco Co. and others making so called “light cigarettes.”

The class included anyone who has ever bought light cigarettes since they hit the market in the 1970s. Defense attorneys successfully argued that this pool of persons was so all inclusive that there was no one who could know how big it might be ort whether persons falsely claimed membership. The allegations were that the cigarette companies were deceptive in their advertising deliberately misleading consumers about the risks of tobacco smoke.
