Threats

I love it when opposing counsel or the opposing party answer a demand letter with a shrill or strident threat of sanctions and countersuits, and no counteroffer.

Usually when this occurs, it means, when all is said and done, they are going to be writing a check to settle this case. And there won't be any sanctions or countersuit. Maybe sanctions against them, not against me.

The responses that worry me are the ones that just calmly and respectfully state why they are denying the demand, and perhaps make some small counter offer that could seem reasonable, but which they know we won't accept.

If you want to make an impression, speak softly and a carry a big stick.

    I have run into those types.
    They are either really stupid or figure "Hey what can I lose~!?"
